Sometime back in round three of this thing when we were all arguing if our  
by-laws and member application, (the whole membership process in fact), allowed 
 board members to vote "no", sometime in the middle of this debacle when it  
appeared that procedures were not followed on a number of occasions we all  
wondered if that left the board/club open to a whole mess.  (I feared the  
worst.)
 
You and I agreed an outside legal opinion might not be a bad  thing and it 
makes sense to me to choose someone from NY familiar with that kind  of law.  
(I 
don't hire a tax attorney to do estate planning for instance,  and one can 
only hope that this lady is a specialist.)
 
Apparently, the fears were justified.  
 
Reading Evan's first post when I saw that a portion of the settlement  
agreement/proposal dealt with having our board take training in antitrust law  
made 
it crystal clear to me that a violation had occurred.  
 
Next...when you seek counsel for anything, an attorney is going to want the  
whole picture.  Warts and all.  How can they be expected to "fix"  something 
without knowing what other shoe may drop?  So, the client goes  under a 
magnifying glass.  It's not comfortable, but it's also not the time  for finger 
pointing and calling the lawyer names.  Case in point, there was  no disclaimer 
in 
the Review on the editorial page.  So...we can expect this  lawyer, if she is 
to do her job, to look at everything and make  recommendations.
 
This isn't a statement about puppy mills or personalities.  It isn't  about 
supporting who voted their conscience and bashing those who in retrospect,  
knew better.
 
"We" are in a mess, and it's about fixing it, learning from our  mistakes and 
preventing them from happening again.
 
(I don't know this attorney from Adam.  I pray she's good!)
