I have told you: Look up lawyers in your area, call and ask them if you can do that without getting into any trouble. There should be plenty of lawyers who will give you some general advice on how to proceed without charging you anything, especially if you mention you are blind. Do not listen to me or others on what we think, just do it and talk for free to 2 or 3 lawyers actually to compare what they say. The amount is so small I can't imagine it would be problematic but I have delt with Government for many years and I always take it by the book. They have unlimited resources and will spend them to punish you if you make a mistake. Where will you get unlimited resources to fight back and not end up with a big fine, losing your Government Benefit elegibility or even doing prison time if they decide to prosecute you for something they consider as criminal activity? If you can not spend a little time to do something in a professional manner just stay away from it. There are allot of folks out there looking to feed on careless risk takers and they are good at it. If, after you talk to a few lawyers, they all say you can do something simple then contact a CPA if you want to handle your taxes or setting up the business entity but that will cost almost as much as a lawyer and they will charge you to do your taxes etc... when you can do them yourself or just contact H&R Block, the business folks and ask them what you need to do after you set up your business structure. You might not have to do anything at all if the dollars are that small, I don't know, Sina doesn't know, The other Rick Doesen't know and if we did that might not apply to your state or perhaps the Feds so use some free resources to find out what to do who are professionals. If the story is the same from several of them I would take their recommendation whether it ment starting a business or just adding any income into my personal taxes at the end of the year. Note that if you do that I think you can not write off expenses since you are not a business, again I don't know.

I was looking at starting out, recording what I made, then if it got over say, $400 depending on how business was, I'd turn in the papers and hire someone to do the work so I can afford them by that point, then I can work up to a business licence, and llc. That a decent approach? Thanks, Tyler Littlefield Web: tysdomain.com email: tyler@xxxxxxxxxxxxx My programs don't have bugs, they're called randomly added features.----- Original Message ----- From: "Sina Bahram" <sbahram@xxxxxxxxx>To: <programmingblind@xxxxxxxxxxxxx> Sent: Monday, June 01, 2009 9:34 AM Subject: RE: home business-getting startedYou do not need a license, but you do need a tax guy to do some of the paperwork. When folks pay you, they can contract you as a 1099 employee , butthat means you pay both parts of federal and state, so the taxes are higher, but it's ok because you probably have a ton of expenses to show. Just phrase it as a soul propriotorship. Just get a good CPA. You are going to be a professional or aContractor in effect. Getting a Lawyer is a very good idea but the paperwork he will need to do is very standard and minimal so he should not charge much, shop around by phone. I will go back and see if I saved any notes whenI was about to do the same thing. You just need to keep track of what youtake in and spend and the hours you actually work. If you are on SocialSecurity or Medicaid there are rules about how many hours per week you canwork and how much you can make before you lose your benefits. There are also trial periods for Social Security etc... It all gets a little complicated and an experienced lawyer can help you sort all the ifs ands and buts. You don't have to actually start a business that requires anything more than you keeping track of what you do, no accountingsystem stuff other than just what you normally might do with a little more detail and documentation in case there are any questions. The only thing Ican say is that you will be like a Doctor, Plumber or other Professional providing a service. I don't know if you actually sell products if there isany diference. There are several types of business. The Type S Corp is for small businesses who don't want to Incorporate, it is for a single personorsmall partnership. It is overkill though since it requires some accounting hoops. Thereare a couple of other business forms, I forget off the top ofmy head, for contractors and professionals with fewer requirements. I willscrounge around a little but you should get a lawyer in any case. You wantlimited Liability so if sombody sues you you are only responsible forpayments to the extent of your business, you want simple or no additional accounting tax requirements and any other safety and easy helper featuresofthe business type you are going to start. I think my lawayer was going to charge me about $150 to set up the business. I would have had to report mytaxes quarterly and had limited liability to the assets I put into the business. I was going to work less than the maximum hours allowed under Social Security so would not lose that income and run the business as a part time venture. This sounds like a plan for you as well depending on your current involvement with Government Programs like Social Security. Well, I will see if I saved anything on my business plan which included the legal framework. I will get back to you later but start googling and find a number of lawyersin your specializing in small business startups who you can ask questionsof on the phone before you have to pay something to start the business. Youwill learn more as you google, hear from me and talk to the lawyers. Also, ask on other lists how self employed programmers are handling the businesstype and tax requirements. Any ideas/advice would be great; I wasn't sure where to ask, and I believethere are a few people on the list that run a business that may be able tothrow out some ideas.
