this is a problem that is not going to go away easily. gmail, yahoo or even
your own domain name and the mail id that comes with it are all open to
subpoena. even if you have a mailid@xxxxxxxxxxxx you still need to encrypt your
data and send it to the recipient. if the recipient does not have the
decryption key, there is no way to decrypt it.
so, you need to shared the decryption key with the recipient securely. that
pretty much means that you cannot communicate securely anything with a person
whom you are having first contact. There is infrastructure in place such as key
distribution centers to get over this. But the moment we have anything
adequately big as an infrastructure, its open to subpoena.
I don't see why gmail should be seen as evil if they are willing to release
account information on subpoena. without it, they are not even permitted to
operate in the country.
