Briefly
From 1st January 2017 Worcestershire County Council will be acting as the fund
holder / accountable body for Worcestershire Voices. WCC will not be providing
back office support. We will be using an independent comms and marketing
specialist (who already works for another county-wide VCS organisation) to
handle our e-bulletin and to develop our wider communications.
Some background
As you know in August Community First and Worcestershire Voices agreed to a
severing of our SLA for accountable body and service provision support and we
have been working since than to try to ensure a smooth transfer to the new
arrangement. In early October Derek and I met with the General Manager and
Trustees of Community First to agree the transfer arrangements. We agreed that
the transfer of the funds would take place on 31st December 2016 to a new
accountable body.
Over the last few months we have explored the options with a number of VCS
organisations but it became clear that splitting the AB and comms support
functions was the most practical and cost effective way forward. WCC are
willing to hold the funds and act as our accountable body at no cost. The
independent comms specialist as quoted a good rate for her services and is
flexible about the amount of time spent on supporting us.
Community First's trustees have been unwilling to pass on the email addresses
on our e-bulletin list. They argue that
1. the data is theirs held for WV,
2. 'personal data' under the Data Protection Act, and
3. must be transferred to an incorporated body
We have argued that the data belongs to WV and should be passed over as there
is no transfer to another organisation. (We have also argued that email
addresses of 'members' of a group such as WV is a specific exclusion from the
act.)
On the assumption that Worcestershire Voices would use the same organisation
for the AB and SP functions in October we agreed a 'form of words' to satisfy
Community First. These were the words used by Community First earlier in the
month in my name but which was not authorised by me. Despite a request that
they correct the inaccuracies in the email message Community First Trustees
have refused.
I hope that the email list will be sent in early January to WCC. WCC has agreed
to receive the mailing list from Community First.
I hope this clarifies the situation.

Permission to pass on your Contact Details
Dear Colleagues,
Since Worcestershire Voices was formed almost five years ago Community First
has acted as our Accountable Body and has provided ‘back office’ services. On
our behalf they have maintained a list of contact email addresses along with
some details including names and organisations. This list is used for the
monthly e-bulletin.
From 1/1/2017 Worcestershire County Council (Alan Smith, Partnership
Relationship Manager, Content and Communications, Worcestershire County
Council, County Hall, Spetchley Road, Worcester, WR5 2NP) will be providing
Worcestershire Voices with ‘back office support.’
In line with best practice around Data Protection we are seeking your
permission for Community First to pass on your contact details to
Worcestershire County Council. We are working on the assumption that you are
still interested in receiving our monthly e-bulletin but if you’d prefer that
your email address is not passed on to Worcestershire County Council please
reply to this email by 31/12/2016 *.
We hope that there will be a seamless transition and that normal service will
be maintained throughout.
