Actually I didn't think that through before I answered. Sorry for the doubling posting everyone. They probably have a permit to remove the nest if it's on a cell tower. If things still work the way they did a few years ago when I was surveying these sorts of things, the Virginia Department of Game and Inland Fisheries issues permits for raptor nest removal from cell towers. You can call them and someone there should be able to tell you if there is a permit to remove nests on that tower.
