For you folks interested in wildlife laws: Possession of dead blue jays, regardless of how they were acquired, is a violation of the Migratory Bird Treaty Act unless the possessor has the appropriate license from the U.S. Fish and Wildlife Service and/or state wildlife agency. The Lacey Act addresses trade (i.e., buying/selling) of animal or plant parts taken in violation of a U.S. or foreign law. If I'd known that at the KTOS meeting last week, we wouldda sung for ye' About swallows... Thursday I birded Cades Cove, Kyker Bottoms and Hiwassee Wildlife Refuge. At Kyker, I had at least 200 swallows! I couldn't find anything but Tree, despite a lot of effort, but I was happy to see them. Less satisfying were the invisible Chorus Frogs that I tried hard to see with no luck! I had 2 Common Snipe - the same 2 I had last time? There were also about 60 Ring-necked Ducks and a smattering of others - Northern Shovellors, Mallards, Green-winged Teal, Gadwall. The Wigeon that were there 10 days prior were not around. I still can't see the Loggerhead Shrikes that everyone else there reports. Ok, I'm gonna sandwich bird sightings with another complaint. Boy, I hope you folks aren't tired of me yet... On the way to Kyker (southern Blount County - TWRA land) I passed a yard with about 10 dead birds hanging by twine from trees in a front yard. All I could ID were crow and Blue Jay. Now I believe Tennessee has legal crow hunting (WHY? - nevermind, that's another topic) but Blue Jays are federally protected. I asked a TWRA maintenance guy I ran into about it, and said the law enforcement folks knew about it, but couldnt' do anything because the landowner said he found them and didn't kill them. Now I beleive the Lacey Act from the 1920's makes it illegal in the US to have bird parts of a migratory, non-game species in your possession...wouldn't tieing one up in a tree constitute possession? I hope a TWRA person will check this out... I got a picture, despite the glowering eyes of the landowners. Ok, back to birds! At Cades Cove I had the biggest flock of Wild Turkeys I've seen in Great Smoky Mountains National Park... 27, including one leucistic bird that looked a lot like a Thanksgiving escapee. Also had GOBS of Brown Creepers on the small road to the sewage lagoons - at least 15! A nice Northern Harrier at the Cove looked to be the exact same plumage as one I had 2 hours later at Kyker - 2nd year male, just turning color. Same bird? Could be. I haven't seen one at either location this year. Butterflies were nice, too. I had a Mourning Cloak, 2 species of Sulphurs, and a couple Red Admirals, all at Kyker. Sparrows seem to have flown the coop. Nothing but Song, Swamp White-throated and Chipping this weekend. The number of Swamp at Kyker seems to be way up. The active Bald Eagle nest that Tracey and I saw was only about 40 feet off the trail at Prentice Cooper SF. Anyone know if that trail ever gets closed?
