An interesting decision just came down in San Diego.
The judge decided that animals were products. Previously in most states
they are property. In the past, California has always considered animals as
property. There is a trend in California to allow pain and suffering for
the loss of an animal, and it seems to be growing in the country.
A rat was sold in Petco, and it bit a child who died 17 days later from
rat bite fever The judge decided Petco has a better chance to know the rat
was infected, (rat bite fever is common in rats), and therefore held the
store liable under product liability. In New York, Connecticut and Oregon,
pets are already deemed products.
This is a big change in California. I haven't decided if I like it or not.
