TOP NEWS Oklahoma Commercial Pet Breeders Act Regulation. **PUBLIC HEARING HELD** PIJAC was joined by organizations both within and outside Oklahoma, as well as countless breeders, in submitting comments in response to the Oklahoma Board of Commercial Pet Breeders proposed regulations implementing the Commercial Breeders Act. A public hearing following the close of the comment period on that proposal was well attended by opponents and an original sponsor of the legislation testified that provisions in the proposed regulations exceeded the law’s intent. Among provisions of the proposal are fees of up to $1,350.00 a year, bonding requirements, and comprehensive animal care standards that would be inconsistent with federal law and recognized standards of care. Repeal of Missouri Puppy Mill Prevention Cruelty Act. **PRE-FILED FOR 2011** Legislation has been introduced to repeal an anti-pet initiative following its narrow election-day victory in which the vast majority of districts within the state voted in opposition to the measure. The initiative, known as Proposition B, enacted the so-called “Puppy Mill Cruelty Prevention Act” and included expensive mandates that would do nothing to advance the welfare of dogs but would put countless humane, quality breeders out of business. Shortly after the election, legislators had pledged to repeal some or all of the provisions of this HSUS-promoted initiative. Senate Bill 4, prefiled for the 2011 legislative session, would repeal the Act in its entirety. BREEDER/KENNEL Florida. **ORDINANCE ADOPTED** The Jacksonville, FL City Council approved a proposed animal ordinance at its December 14thmeeting by a vote of 96-2. The approved substituted ordinance contains a formal fee schedule as well as amendments to the original proposal.Please visit the “Breaking News” page of the PIJAC website tomorrow (Thursday, December 16th) for an updated PIJAC PetAlert, which will provide more detailed information on the adopted ordinance. Utah. **PROPOSED ORDINANCE TABLED** Due to great public response, the Salt Lake County Council has tabled an ordinance that would require licensing for anyone who breeds more than one litter of dogs per year. The proposed ordinance also provides specific kennel and care standards as well as recordkeeping requirements on all dogs. The Council plans to reevaluate and study the matter further but no meeting date has been set by the Council to reconsider the proposal. Read PIJAC’s PetAlert on this issue for more details. DOG/CAT New York. **PRE-FILED FOR 2011** Legislation has been prefiled for the New York 2011 legislative session that would mandate microchipping in all dogs by four months of age. Senate Bill 62 lists the information the microchip must contain and calls for establishment of a state registry of identification information. PET STORE/DEALER Colorado (Fort Collins). **PROPOSED BALLOT INITIATIVE/ORDINANCE** The City of Fort Collins is making news as signatures are currently being gathered to put an initiative on the April 5, 2011 city ballot which would ban the sale of puppies, kittens and other small animals (to include birds, amphibians, reptiles, gerbils and hamsters) in local pet stores. Petitioners must collect 2,517 signatures of registered city voters in order for the initiative to make it on the ballot or the City Council could adopt the ordinance as written. PIJAC is closely monitoring the progress of this issue and will post a PetAlert if and when an initiative is formulated. Texas (Austin). **CITY COUNCIL VOTE SCHEDULED** Following a recommendation by the Austin Animal Advisory Commission to ban the sale of dogs and cats by pet stores, the Austin City Council is poised to enact that ban into law. Included in the City Council’s agenda for consideration during its Thursday December, 16, 2010 meeting is a proposal amending its ordinance regulating pet traders. In addition to amendments that would impose additional restrictions on the sale of dogs and cats, the Council will consider an outright ban on the sale of dogs and cats by pet stores. AMPHIBIAN Federal. **COMMENT DEADLINE TOMORROW** PIJAC members interested in receiving talking points on the U.S. Fish & Wildllife Service (USFWS) Notice of Inquiry (NOI), published in the Federal Register on September 17, 2010, should click here. The Service is specifically seeking comment with respect to regulating the importation and between state movement of amphibians through the Lacey Act as a means of minimizing the spread of "chytrid fungus." The deadline for response is December 16, 2010. PIJAC staff is reviewing the science and the proposed petition and is formulating a response.
