TX-RPOA E-News May 2, 2006 California's SB 861 has far reaching effects regarding mandatory spay/neuter and breeding regulations for all dogs and cats which go far beyond the state's borders. The law was the inspiration of radical "animal rights" activists in California who don't want animals bred for any reason, whether you eat them, wear them or pet them. They consider this law to be the tool to accomplish their agenda. Following a very successful court case in Ohio, American Canine Foundation is now tackling CA SB 861. All pet owners and dog/cat fanciers are urged to support this effort. Breeders are already regulated by local and state laws regarding leash laws, animal nuisance and animal cruelty laws. Bad breeding facilities are raided on a regular basis in Texas with animals confiscated. Additional laws aren't necessary for the humane treatment of animals. ACF is based in Seattle Washington and has members and representatives in the majority of the United States. ACF has won every court battle we have litigated. ACF just won a decision from the Sixth District Court of Appeals in Ohio that breed specific legislation violates three areas of the 14th Amendment of the United States Constitution. No other case in history has ever given dog owners such a decision. In California SB 861 was passed into law in January 2006, it allows the control of breeding canines of specific breeds to the mercy of animal control. It allows for mandatory spay and neuter of specific breeds. SB 861 was passed using flawed and manipulated data provided by extreme animal rights organizations. Several areas of California are implementing laws based on SB861, LA County is passing law that requires all breeds altered with stringent exemptions that will give all control of dog breeding to animal control. The same thing is happening in Riverside County and if these types of laws are not stopped the animal rights organizations who want the end to dog breeding will get their way !! ACF in March 2006 filed a federal lawsuit challenging SB861, in the Eastern Federal District Court of California. We attached a copy with this email. ACF will be amending several more constitutional arguments to the lawsuit and we address LA County, San Francisco and other cities and county's implementing spay and neuter laws and breeding requirements in the lawsuit. We have been receiving requests asking us to file a lawsuit against LA County asking for an injunction to stop their ordinance. Second reading will be taking place May 2, 2006 and if the law passes ACF would like to pursue litigation. The State of California sided with extreme radical animal rights organizations using manipulated data and completely ignored accurate scientific data presented by quailified experts when passing SB861. It can be proven that LA County Animal Care and Control does not have an overpopulation of dogs, it can be proven that they are not experts in canine breeding and should not be allowed to determine who can or can't breed dogs. It can also be proven spay and neuter does not reduce aggression and most of all it can be proven that the spay and neuter laws and breeding requirements are supported by the animal rights organizations calling for the end to domestic pet ownership based off of manipulated data. ACF has requested all the data bases from the administration office of the LA County Animal Control and Care Agency and we are having the data evaluated by experts. ACF will update this email list May 3 2006. Data request includes: 1. All shelter intake reports from 2000-2006 including names, phone numbers, addresses of owners and breeds of canines impounded or dropped off at all LA County shelters. 2. All disposition hearing data bases for owners cited for dangerous dogs from 2000-2006. 3. All data bases for canine adoption from 2000-2006. 4. All data bases for shelter income and expenses from 2000-2006. 5. All data bases on donations received from organizations or private citizens to fund LA County Shelters. 6. All data bases used to support the mandatory spay and neuter law and breeding permits with provisions being proposed by LA County that passed first reading April 18, 2006. 7. All data bases pertaining to the breeding permit law in LA County passed > several years ago including data on enforcement and costs. 8. A copy of a resume from the Assistant Director and Director of LA County Animal Care. 9. All records of employees hired and fired from LA County Animal Care 2000-2006. 10. All data bases including, brochures, flyers and other propaganda used to promote adoption, solicitation for donations and education programs pertaining to canines. 11. All data bases related to exporting or importing canines from areas outside of LA County.
