Is there an ability for a conditional use permit? The county I live in allows
2 dogs no matter how many acres you own. You must have a conditional use
permit approved by the town board in order to be allowed any more... I had to
give a presentation to our board and all neighbors within a mile radius were
notified by registered mail of my intentions and were allowed to express their
concerns during the meeting. It was a pain in the butt, let me tell you!! Not
to mention you have to have a minimum of 5 acres to be eligible for ANY
conditional use permit if in a residential or agricultural zoned area. I think
this sort of thing is much more common than most people realize.

I could hardly believe my eyes on this article which appeared in the
11/1 issue of the Alb. Journal. I will write some of the gist below,
but will cut straight to the point first about what concerns me, with
regard to a pending new ordinance in Torrance County, NM (a rural
area.) Here it is:
The Torrance County Commission is required to hold one public hearing
before adopting the (proposed) ordinance, County Manager Joy Ansley
said. That will be 9AM on Dec. 10. Specifics of the new ordinance
include:
Number of dogs and cats allowed on property:
A quarter acre or less - two animals
A quarter acre to less than 3/4 acre - three animals
3/4 acre to less than an acre - four animals
One acre or more - five animals
That is it! Five dogs and cats maximum, even if a person has a 20
acre property or they will be breaking the law!

Other things included in this ordinance are fines for roaming at
large:
first offense - $25
second offense - $60
third offense - $100 or 40 hours community service
Also - a Dangerous Dog Act will be created. "Dangerous dog means a
dog that has caused serious injury to a person or domestic animal.
Once an animal exhibits dangerous behavior, if you choose to keep the
animal, then it needs a special license."
Another point in the ordinance is stallion containment
rules. "Stallions are incredibly strong animals. They destroy
property and sometimes hurt mares," Foust (Planning and Zoning
Director) said.
