The onerous El Paso Animal Ordinance Revision passed by a 6-1 vote as
written. The ordinance wasn't posted to the city's website until October
1st and the vote was October 5th. RPOA will have a full report asap.
Petland is suing the city and several local rescuers (called animal

Petland sues, says it will close Jan. 1

The last store in the city to sell puppies and kittens has sued its
detractors, and its owner says the store will close Jan. 1 because of a
new
city ordinance that will effectively ban the sales.
The owners of the Petland store at the Las Palmas shopping center are
suing
several animal-welfare organizations over the organizations' claims that
Petland gets some of the dogs it sells from puppy mills -- breeding
operations that keep animals in cruel, unsanitary conditions. Petland says
the claims have harmed its business and is demanding more than $2.5
million
from the organizations.
Marlene Estrada, owner of the Petland franchise, referred questions about
the suit to her attorney, Eric Darnell, who could not be reached Wednesday.
But Estrada said an ordinance passed Tuesday by the City Council will
force her to close.
"We're going to have to close down come January 1," an emotional Estrada
said. "We don't have the resources to stay open without (selling) puppies."
When the new ordinance takes effect Jan. 1, it will ban stores such as
Petland from selling dogs and cats that are younger than one year. Mayor
John Cook proposed another version of the ban this summer, saying it would
reduce the market for puppies and kittens bred in unhealthy "mills."
Estrada says that she and her husband will lose a $1.5 million investment
in
the business and 25 employees will lose jobs.
But animal-welfare organizations such as Great Dane Rescue of El Paso
contend that the puppies sold there and at other pet-store chains are bred
in conditions that are cruel and unhealthy.
Missouri is home to 24 percent of the federally licensed commercial
breeders
in the United States. For years, lax enforcement of state laws has
contributed to some dogs being bred in cramped, dirty, cold cages, the St.
Louis Post Dispatch reported Sunday.
The problem has reached the point that Missouri voters will consider a
ballot initiative that would impose new regulations on pet farms, although
critics say better enforcement of existing laws would be more effective.
The lawsuit filed Monday by Petland says the animal advocates made public
statements and demonstrated outside the store, falsely accusing it of
selling puppies that were bred in mills. It says the acts defamed the
store,
costing it business. And it accused the defendants of entering into a
conspiracy to defame it. Two of the defendants, Dawn Post and Dory Munder,
declined to comment because they had not yet consulted with an attorney.
