[ SHOWGSD-L ] Evan in Court?

On Ed Hillâ??s email  below.   I also took a day off and attended the case a 
number of  years back when Evan argued in from of the California Supreme 
Court  judges.  As Ed implies, Evan was not intimidated and did a great job on 
a  difficult case (I am guessing if they make it as far as this one did it 
must  be a difficult case).  To me, Evan is the consummate trial attorneyâ?¦.he 
 reminded me of what we see on TV shows at times.  If I ever needed a  
trial attorney, I know who I would pick. 



It was more fun knowing Ed and Peter were behind me.  We get  to face a 
panel of judges who are elevated to show you that you remain one of  the little 
people. It was great fun to stand and be face to face with the  justices of 
the Supreme Court.  After the hearing I went to lunch with  Peter and got 
to discuss what he saw.
 
By the time you argue before the Supremes, you usually know  everything 
they are going to throw at you. This time, they had nothing to ask  me, that I 
didn't expect.  
 
The only question that got me pausing was when Chief Justice George  asked 
me, "Mr. Ginsburg.  If we go with your theory of land owner  liability, how 
do we deal with the problem of businesses leaving California due  to the 
cost of doing business?"
 
What flashed into my mind was to say;  "Listen schmuck.   We are the 
judiciary, and we just follow the law. It is up to the Legislature to  deal 
with 
public policy."
 
But, having learned to take my licks at dog shows, I held myself  back.  
What I said was;  "Chief Justice George, that is an interesting  question. 
But, I am but a lawyer trying to argue the law."
 
I saw a grin start on his face. I know he knew what I wanted to  say.
 
I often think that way in court, and at times at dog shows.   There is what 
you want to say, what you say, and then later what you wish you  had said.
 
Not that there is anything wrong with that.
