HI Cyndy,
I had to change my kennel name Rosegarden to Aatache.
Many moons ago, I grew hybrid roses which required a lot of work. Thus, the
work was produced something of beauty, and that was my kennel name. I had bred
Mini Poodles, Kerries and a litter of GSDs under it.
About 2 years go, there was a lady in Florida who bred under the same kennel
name of Rosegarden. I contacted the AKC to see if the kennel name was
registered and it was not. Her kennel was trademarked and it was hers. After a
couple of discussions with my attorney, it was in my best interest to cease and
desist with the kennel name of rosegarden. I thought I would just register it
with AKC and it would be mine and phooey on that person.
In the real business world, it doesn't work that way. It opens me up to being
sued for using her trademarked name even though mine would be 'registered". So,
on the advice of my attorney, we changed it. Anyone who knows Saddlebred
horses, knows my favorite 5 gaited horse was Aattache. So thus I picked it up.
Also, my attorney advised that when you pick up the phone book or advertising
or looking at rankings, "double A" always starts the list for alphabetical
order, thus a good marketing move.
So now, after almost 14 years of using the Rosegarden Prefix, I no longer use
it.
