The AKC can ban anyone for behavior they deem inappropriate. If they have
banned her for life why would she ever pay the fine????? It is a double
punishment and the fine is not collectable. As to why they levied both
punishments? It is my opinion that it was done incase in the future she
appeals to have her ban lifted they can still impose the fine. I think they
were just covering their bases.
The same thing happens with the State Bar. They fine an attorney and
suspend him. Even if for life, if he applies in the future, then he has to pay
the fine before he is reinstated.
I defended two AKC handlers that were suspended for life. We tried the
case at the AKC in New York. The trial was in front of three AKC employees,
with an attorney prosecuting the case from the AKC.
After the hearing I said: "Let me get this straight. I am defending
against the AKC in front of three AKC judges, with a prosecutor from the AKC
and
you think I am getting a fair trial?
We settled with a three month suspension and no fine.
Sometimes life time suspension does not mean life time.
A life sentence in California is seven years. Maybe it is the life of the
Brazilian Gnat Catcher. That is why often someone is given life plus a
day, or consecutive life sentences. How do you figure half time if you have a
life sentence? Figure when someone was going to die, and let them out
half way?
