Many thanks to Judy & Co. for the heads up on the proposal!

A copy of the City of Auburn's draft proposal was uploaded to the
Dog Fed. of NY's elist earlier this morning.  For those not on the
DFNY elist, feel free to contact me for a copy--or just join the
list!

For quick reference, Auburn is a city of about 25,000 residents in
the Finger Lakes area of central New York.

A quick read through of the NINE page proposal shows many, many
issues, including but not limited to:

--tethering restrictions

--restraint limitations, including length of leash and requiring
that the person in control of the dog be "competent". Also, requires
that dogs **on their owner's property** be restrained by either
leash or fence

--limit laws, including a limitation based on number of dogs and
weight for multiple-dwelling units, and townhouses

--barking/other noise limit (3 minutes out of any 60 minute period)

--allows Dog Control Officers to determine whether dogs
are "dangerous" or "vicious", creating due process issues. [NY State
law allows only judges or justices to deem dogs "dangerous",
following a court hearing with decisions subject to appeal.]

--allows individuals to make dangerous dog complaints verbally
and/or without swearing to the complaint [again, contrary to NYS law]

--defines "dangerous dog" to include hunting dogs

--defines "dangerous dog" so widely that almost any dog is captured,
since virtually all dogs "have a propensity, tendency or disposition
to cause injury or threaten the safety of other animals"

--BSL, including Dobies and assorted "pit bulls" as reported in news
article but also Bull Terriers. (Note: proposal is incompetently
drafted and refers to the "AKC breed American Pit Bull Terrier")

More to follow shortly, but PLEASE, if you are going to contact the
City of Auburn to oppose this ordinance in the interim, please don't
cherry pick the issues. The problems with the proposal are far
greater than the BSL, or the limit laws, or any other item(s).

Oppose the draft ordinance completely!
