BACKGROUND =E2=80=93=20
Minnesota already has adequate laws requiring licensing of =
=E2=80=9Ckennels=E2=80=9D that=20
take dogs/cats from shelters or abandoned and stray animals (rescue=20
facilities). The State has standards for commercial breeders or =
dealers that sell=20
dogs/cats to institutions or other dealers. The Consumer Protection =
statute=20
(1992) applies to pet dealers, breeders who sell to the public or =
brokers who=20
purchase animals for resale. SF 121 is an unnecessary animal rights =
agenda to=20
make conscientious breeding programs for cats or dogs impossible in =
Minnesota.=20
HIGHLIGHTS =E2=80=93=20
**The=E2=80=9D Dog and Cat Breeders Act=E2=80=9D would license, inspect =
and regulate=20
everyone who possesses 6 or more =E2=80=9Cadult, intact breeding =
females=E2=80=9D (dogs and/or=20
cats). Kittens/puppies 20 weeks of age are considered adults.=20
** Included are detailed and stringent standards of care as well as=20
transportation and husbandry requirements. =20
**Inspections are required at least annually without notice. =20
** A veterinarian-inspector who determines substantial risk to an =
animal=E2=80=99s=20
health or welfare may euthanize the animal for reasons not limited to =
disease=20
or pain.=20
OPPOSITION =E2=80=93 =20
There are many flaws in this bill. Let the Senators know of a few =
primary =20
problems. Suggested points to make in your own words. =20
** Minnesota will lose its best source of home-raised pedigreed kittens =
and=20
purebred puppies. Supporters claim the bill exempts =E2=80=9Chobby =
breeders=E2=80=9D. SF=20
121 will eliminate many fine home based breeders from the state because =
of=20
onerous and unrealistic requirements. =20
**Possession of =E2=80=9Csix or more adult breeding female =
animals=E2=80=9D means a=20
combination of dogs and cats i.e. persons with 3 intact female dogs and =
3 intact=20
female cats would be regulated. A cattery with 6 intact female cats =
represents=20
a small breeding program concerned with genetic diversity. Enforcement =
would=20
be expensive and difficult as the numbers of cats/dogs in a typical =
breeder=E2=80=99s=20
household will fluctuate.=20
**This Bill=E2=80=99s definition of =E2=80=9Cpossess=E2=80=9D is =
unrealistic - =E2=80=9Cto own, have an =20
ownership interest in, care for, have custody of, or have control =
over=E2=80=9D. For=20
example, the 6 intact female threshold would include kittens over 20 =
weeks=20
being evaluated for show/breeding potential, co-owned cats who may even =
live=20
outside of the state, female cats temporarily in the home for stud =
service or=20
on lease. And, this would include any intact female dogs living in a =
cat=20
breeder's household.=20
** Unnoticed inspection is intrusive of home privacy. Kittens are =
raised in=20
people=E2=80=99s bedrooms in homes not open =E2=80=9Cduring normal =
business hours=E2=80=9D. Yearly=20
inspection is unnecessary and expensive for the State. A single =
complaint=20
would trigger an investigation of a breeder=E2=80=99s home, cats and =
records. A=20
correction order could mean a penalty up to $10,000.=20
** Standards of Care were derived with no input from hobby breeders. =
These=20
standards are overly detailed, impractical or undesirable for breeders =
who=20
raise cats/dogs in their homes. For example - air transport would be =20
impossible since conditions in transit cannot be controlled. If an 8 =
week old kitten=20
cannot be transported at all how does one receive veterinary care? =
Cats=20
cannot be =E2=80=9Choused=E2=80=9D in outdoor confined areas ever =
=E2=80=93 even in good weather. =20
Kittens can not be =E2=80=9Choused=E2=80=9D with adult altered family =
pet dogs or cats. A female=20
could not be bred on the next cycle following a litter even when =
advised by a=20
veterinarian. Husbandry matters should not be decided by government. =
Tell Committee members that conscientious hobby breeding usually does =
means=20
6 or more intact females and good breeders will not be able to comply =
with=20
this bad law. SF 121 will only advance an agenda to stop cat and dog =
breeding=20
in Minnesota.=20
