Isaac,

I hope that all is well with you.  The latest news on the court date is
that the case is #30 on the Nonjury Roster for February 12.  I do not
expect the case to go forward then for a variety of reasons, primarily
including the availability of all attorneys/witnesses as well as the number
of cases ahead of us.  The parties are working on obtaining what is called
a “Date Certain” trial which is a definite date for the trial.  I am
expecting that to be in either April or June but won’t know until the
motion is submitted.  The case was previously on the jury roster but the
parties agreed to strike the jury demand in order to have a judge rule on
the whole case.  We think that is favorable for us given the complexity of
the case and the timeline of things.  Feel free to give me a call if you
have any other questions.
