My wife is an artist, and I remember reading something
about this when he was first arrested.  He wanted to
incorporate bacterial and fungal cultures in some of
his artwork.  Being consciensous he wanted to make
sure that the things that he cultured were pure and
benign, and the only way to obtain those is through
the scientific community, which he did, via his
university connections.  There are two problems -
first is that there is a contract that the university
signed with the supplier of the cultures which
narrowly defines what they can do with the cultures,
and artistic use was not included in that definition.
The second problem is that we have a government
apparatus who are paranoid, and feel the need to
harass anybody who does not fall in the mainstream. 
They saw the artists work which was critical of the
establishment, along with what looked like the
components for bio-terrorism, and bang! the paranoi
kicked in.
