On Windows, you may want to exclude the Agent *.q files (network\agent\*.q) as we have found that you get Agent crashes / Dr Watson errors if your backup locks those files. This will depend on how your backup software locks files it is backing up. Of course, this assumes you don't have any database files (eg control, redo) under your Oracle home dir - your database will have problems if they get locked.
