Fox, Discovery Nets Back On Time Warner Cable's iPad App
Viacom, Which Is Suing the MSO Over the Service, Is Only Programmer Holding Out

Viacom is the only programmer still withholding its programming from
Time Warner Cable's iPad app for streaming live TV to customers'
tablets, after the MSO reached agreements with Fox and Discovery
Communications to return their programming to the service Friday.
TWC added Fox's National Geographic Channel, FX and Fox News Channel
as well as Discovery's Discovery Channel, TLC and Animal Planet. It
was not immediately clear how the differences were resolved.
The return of Fox and Discovery to the TWCableTV for iPad app was
announced in blog posts by Time Warner Cable director of digital
communications Jeff Simmermon. He didn't provide any explanation for
why the networks were returned.
TWC and Fox reps declined to comment. A Discovery spokeswoman said
the company does not "discuss affiliate relationships."
On March 31, Time Warner Cable removed a dozen channels --
Discovery's Animal Planet, Discovery and TLC; Fox's FX and National
Geographic Channel; and Viacom's BET, CMT, Comedy Central, MTV, Nick,
Spike and VH1 -- from the app after receiving cease-and-desist
notices from the programmers.
Last Thursday, Time Warner Cable filed a lawsuit against Viacom
requesting a declaratory judgment in a federal court seeking a ruling
that the cable operator has the rights under its carriage agreement
to deliver Viacom's programming to any device in a subscriber's home.
Viacom responded with a lawsuit accusing TWC of breach of contract
and copyright violation, asserting that distribution of its networks
to iPads represents a separate usage not covered under existing
agreements.
Viacom also has objected to Cablevision Systems' similar Optimum for
iPad app, although the media company has not initiated legal action
against Cablevision.
Separately, TWC added four networks on Thursday afternoon: Sundance
Channel, Wedding Central, Lifetime Real Women and Military History
Channel.
