Why would Apple complain?

The technology does what Apple is asking: it converts the ads to HTML5 which can be viewed via the Safari browser.

And just in case you might be confusing this with an attempt to compile a Flash app that can be distributed via the App store, its not.

The annoying part is that this is a work around to deliver more ads...
