See an update below from Daryl Braithwaite, the City's Director of Public
Works, on that sudden appearance of a wireless facility in a corner of the
Takoma Horticultural Club's Centennial Garden.

Hello All,
I have been looking into this location to determine the status and whether or
not Verizon Wireless and their facilitator, N B & C followed required
procedures. In short, they did not.
I am still working through the various agencies, but I have been told by
Montgomery County Tower Committee staff that they have no application for this
address. I have not yet confirmed whether a County Dept of Permitting Services
permit was pulled, but I have asked Tower Committee staff to provide me with
the appropriate contact at DPS. Apparently DPS has enforcement authority and
the Tower Committee does not, so any action on the County's part would be
initiated by DPS.
The applicant did receive a permit from State Highway. That permit was issued
7/28/21. In reviewing the documents that were included with the SHA permit, it
appears to me that the location is just outside the State Right of Way and
within the City right of way. SHA staff have indicated they believe otherwise,
and I expect to have a follow up conversation with them tomorrow.
I have reached out to the company that facilitated the project, Network
Building and Consulting (NB&C) and am in contact with the Project Manager who
is looking into the record.
I have also reached out to PEPCO in an effort to determine which office
installs the meter and to request a delay so the facility can go through the
required County and City review and permitting process. I am expecting a follow
up from Pepco on Friday.
As to actions the City can take, I have asked the City Attorney for guidance.
At this point it is not clear that the City has authority to issue a Stop Work
order. I expect to receive more direction from the City Attorney on Friday.

As I acquire any new information, I will update.
