Microsoft and other internet companies will announce lawsuits against
spammers under the US Can-Spam Act, and will detail a technical initiative
aimed at stopping the onslaught of unsolicited e-mail.

The lawsuits announced under Can-Spam (Controlling the Assault of
Non-Solicited Pornography and Marketing) will be among the first since the
law took effect on 1 January, and will target "serial spammers".

Three Ontario residents working from the Kitchener area have been named
among dozens of defendants in a lawsuit aimed at stemming the tide of
annoying junk e-mail called spam.

The lawsuit, filed yesterday in California, names Ontario residents Eric
Head, Matthew Head and Barry Head, as well as several "John Does," and
says the defendants have sent hundreds of millions of spam e-mail messages
to Yahoo! users between May 2003 and now.

None of the allegations has been proven in court.

The defendants were on Yahoo! Mail's "Most Wanted" spammer list, Yahoo
said in a statement.

The lawsuit was one of six launched yesterday as part of a collaborative
anti-spam effort from e-mail and Internet service providers in the United
States. Other lawsuits were filed by America Online Inc., EarthLink Inc.
and Microsoft Corp. against hundreds of defendants.

The lawsuits are the first major ones under a new U.S. "can spam" law
introduced Jan. 1 that offers new enforcement tools and criminalizes some
tactics spammers use to spread junk e-mail. The law prohibits senders of
unsolicited commercial e-mail from disguising their identity by using a
false return address or misleading subject line.

The recently enacted "Can-Spam Act" might make it easier for Internet
service providers to sue junk e-mailers, but several experts said that
ISPs have been suing for years only to see the spam problem grow worse.

"Suing spammers will stop those spammers. But as time has shown new
spammers will come in to take their place," said Ray Everett-Church, chief
privacy officer of the E-Privacy Group.

America Online, EarthLink, Microsoft and Yahoo, which yesterday filed six
lawsuits against hundreds of spammers, said that the law, signed by
President Bush last December, gives them a powerful weapon against spam.

All four companies have used a variety of state and federal consumer
protection, fraud and trespassing laws to sue junk e-mail marketers with
varying degrees of success.

Tim Cranton, a senior attorney for Microsoft, said that the Can-Spam Act
lets companies avoid the tangle of different legal tactics they can take,
and also lets them seek higher damage awards.
