How 'Culture' Became a Scapegoat For The Powerful at PSU

What the report does not suggest are the punitive sanctions that the NCAA has imposed against the entire PSU football program. By imposing these unprecedented sanctions, the NCAA is already stretching its bylaws. Such a move would be commendable if it were done for the sake of bolstering ethical integrity. But why didn't the NCAA follow the experts' suggestions in the Freeh Report?

NCAA President Mark Emmert handed down the sanctions based on limitations determined by the Executive Committee and the Division I Board of Directors. One of the limitations was that Emmert could not make demands to which PSU would not agree, an arrangement known as a consent decree. Furthermore, Emmert's options were limited to fines, win-loss record adjustments, scholarship restrictions, and integrity commitments, among very few others.

These limitations effectively castrated Emmert, leaving him impotent to do anything more than impose crippling and unfocused penalties against the entirety of PSU's football program.

The NCAA could have demanded meaningful changes in PSU's institutional structure and operations. They could have imposed specific sanctions against administrators as they have against coaches in the past who failed to uphold a minimal standard of ethical responsibility. While the judicial courts are responsible for prosecuting crimes within the justice system, the NCAA could have made sure that a tragedy like the Sandusky scandal doesn't happen again. It could have made the Freeh report's policy suggestions a reality throughout the institutions under NCAA jurisdiction.

Why didn't this happen?

Enter "culture."

.

Nomenclatural accuracy may seem trivial, but the NCAA's recent actions demonstrate what happens when words like "culture" get thrown around carelessly.

.

Rather than thoughtfully address the nuances of institutional and community culture at PSU, the NCAA has appropriated a vague conceptualization of "culture" for its own purposes. It has distributed the failure of a small group of administrators across an entire university and its misguided "culture."

.

In a July 13 article titled "NCAA better sanction administrators," ESPN writer Jay Bilas wrote, "The NCAA never, and I mean never, takes action against one of its own, a university president." Instead of calling out administrators by name, or readjusting the power dynamics that allowed these individuals to cover up Sandusky's misconduct, the NCAA has placed blame on a new scapegoat: the anonymous "culture" of football at PSU.
