On November 19, 2011, at approximately 5 a.m., 68-year-old Kenneth
Chamberlain Sr. was at his home located at 135 S. Lexington Avenue, White
Plains, New York.
STORY: HE HAS A NAME: Ervin Jefferson, Shot To Death By Two Security
Guards
A 20 year veteran of the Westchester County Department of Corrections,
Chamberlain proudly served as a Marine, receiving an honorable discharge.
His medical alert device sent an alert to his service provider, which
placed a call to the City of White Plains Department of Public Safety. In
response to the call, police officers, firefighters, and emergency medical
technicians went to his home.
The police knocked on his door and he told them that he did not need
assistance and there was no medical emergency. He told them that he did
not call them. Despite being told that there was no need for their
services, the police refused to leave and insisted that he let them into
his home.
Despite telling them he did not need assistance the police continued to
insist that they enter the apartment.
Chamberlain later contacted his medical alert service provider while the
police were banging on his door and asked them for help.
He told them that the White Plains Police employees were outside his door
and were going to kill him.

WHITE PLAINS A White Plains man whose father was shot and killed by
police in November met with Westchester County District Attorney Jane
DiFiore on Thursday afternoon and was assured that a complete
investigation was being conducted and that all evidence gathered will be
presented to a grand jury.

Kenneth Chamberlain Jr. has called for city cops involved in the incident
to be criminally prosecuted and said that the officer who shot his father
should face a second-degree murder charge.
.
After his meeting with DiFiore, he criticized police for not releasing the
name of the officer who fired the fatal shots and city officials for not
speaking publicly about his father's death.
.
DiFiore did say to me that she will put all the evidence before a grand
jury and will make sure that it's a full and fair investigation,
Chamberlain said. My major concern is why have they not released the name
of the officer.... The DA said they cant, but Im wondering why the police
wont. This raises my concerns. Its only fair that the people know who that
person is.

Chamberlain also said hes upset that Mayor Tom Roach has not spoken to my
family about the death of my father. No public officials have said
anything about this.

Kenneth Chamberlain Sr., 68, was killed Nov. 19 at his 135 S. Lexington
Ave. apartment by officers who responded after family members said his
medical alert device accidentally went off. The family said Chamberlain
told police he was OK and that there was no emergency and the medical
alert company called to cancel the alarm, but cops insisted that
Chamberlain let them in to make sure everything was all right.

WHITE PLAINS, N.Y. - The family of a man shot in November by police in a
White Plains public housing complex said Wednesday they have a recording
from the incident proving that police and emergency personnel used a
racial slur before the shooting and are filing a wrongful death suit.

Kenneth Chamberlain Jr. said on Wednesday his lawyers had filed a notice
of claim informing the city, White Plains Public Safety Department, and
White Plains Housing Authority to expect the wrongful death lawsuit.

"After listening to the audio and looking at the video, it was very clear,
in my opinion that there were no reasonable officers on the scene. Their
job is to diffuse the situation, not create one," said Chamberlain. "White
Plains PD murdered my father. Im asking that these police officers be
brought up on criminal charges, not just the officer that did the
shooting, but any and all officers that were on that scene because someone
should have stopped that from happening."

The officers' alleged use of a racial slur while demanding that
Chamberlain Sr. open the door prompted the son to label the incident a
hate crime.

"People are very quick to always say that when a situation happens in a
community of men and women of color that we are quick to pull the race
card," said Chamberlain. "I did no such thing this whole time. The only
time that it came up was when we hear them say, 'We dont give a f***' and
then use the n-word. So from that point on, they made it racial.

"I'm out here fighting for the justice of my father, doing something that
I know that he would do had the situation been the opposite or reversed
and it was me that got shot."

Lawyers representing the family said an accidentally triggered Lifeline
medical alert sent between 10 to 12 officers to Chamberlain's home at 5
a.m. on Nov. 19. The former Westchester County corrections officer told
police he didn't need assistance and Lifeline attempted to retract the
alert. The lawyers said officers repeatedly taunted the victim while
demanding he let them in.
