MARTINSBURG, W.Va. The Martinsburg-Berkeley County branch of the NAACP
has asked for clarification and a detailed accounting of the federal
government's review of the evidence connected with the March 2013 shooting
death of a Virginia man by five police officers in Martinsburg.
The inquiry sent this week to U.S. Attorney William J. Ihlenfeld II comes
after the U.S. Justice Department announced April 18 that it found
insufficient evidence to pursue criminal civil-rights charges against the
officers.

Wayne A. Jones, 50, who was black, was shot more than 20 times after
police said he shrugged off two jolts from a stun gun, fought with
officers and stabbed one of them.

The officers are white.
.
U.S. District Judge Gina Groh dismissed a $200 million lawsuit filed by
Jones' family against police officers and the city of Martinsburg in 2014.
The case is pending before the 4th Circuit Court of Appeals in Richmond,
Va.

Groh ruled the use of deadly force was reasonable and justified.
In a four-page letter to Ihlenfeld, Martinsburg-Berkeley County NAACP
chapter President Hubert Smith made 17 specific requests, including copies
of information or records that detail the scope of the federal review, the
hours spent on the case, and travel vouchers and emails between Ihlenfeld
and the team of federal prosecutors and authorities that reviewed the
evidence.

Records and documentation of independent forensic analysis of the knife
said to be involved in the incident also was requested, as were audio
transcripts of the dash-camera recordings from the police cruisers that
were driven by the officers involved.

The NAACP also asked for Ihlenfeld's analysis of Martinsburg Police
Department statistics concerning the number of arrests against minorities
versus white residents, and the volume of jaywalking infractions given to
white residents versus those given to blacks and other minorities in the
city.
