Jackie, 

The pattern on the forewing clearly makes this a Catocala.  I can't tell the 
size and obviously cannot see the underwing pattern but it looks similar to 
8878.1 C. lineella (Little Lined Underwing), an oak feeder that flies in 
July-Aug and occurs in our area.
