** Mailing List Nasional Indonesia PPI India Forum ** Managers of Truth Commissions Affinity Group (MTC) Seventh Meeting February 21-25, 2005 Hyatt Aryaduta Hotel Jalan Prapatan 44-48 Jakarta 10110 The Process of Creation of Truth-Seeking Mechanisms in Indonesia The need for authoritative historical clarification and fair settlement of human rights violations are essential components of meaningful democratic transitions. Truth commissions have been useful tools to achieve those goals, when established after careful consultation and enjoying wide credibility. The creation of truth commissions must be a careful process, responding to authentic needs and national characteristics; while the experience of some commissions may serve as powerful inspiration, imitation may lose the opportunity to incorporate the rich lessons of actual practice. The Indonesian House of Representatives approved in September 2004 a bill for the creation of a Truth and Reconciliation Commission (TRC), charged with the clarification of cases of gross human rights violations occurred during a period of over fifty years, since the independence of Indonesia. While the intention to revisit the painful legacies of an often authoritarian and violent past is commendable, the project has been criticized by national and international organizations as limited in its powers of historical review and slanted against the interests of the victims. Also, in December 2004, the Indonesian and the Timorese governments announced their intention to establish a bilateral "Truth and Friendship Commission" (TFC) to provide a non-judicial solution to the problem of outstanding impunity for the crimes committed by pro-Indonesian militias during the popular consultation that took place in Timor Leste in 1999. Such a proposal has been rejected by both Indonesian and Timorese civil society organizations. In such a juncture, it is desirable to share the lessons learned in truth commissions established in other countries, identifying the best practices as well as the mistakes, ascertaining the desirable relations between truth-seeking and criminal justice and contributing in a positive way to enrich the Indonesian process of historical clarification and transitional justice. Managing Truth Commissions (MTC) MTC is a group of like-minded experts created in New York in December 2002, as an initiative sponsored by the International Center for Transitional Justice (ICTJ). Its objective is to promote the exchange of ideas and strategies among senior managers of existing and past truth commissions, contributing to the best success of historical clarification initiatives around the world. Members of MTC have since met in Lima, Peru; Bellagio, Italy; Freetown, Sierra Leone; Rabat, Morocco and Asuncion, Paraguay to discuss the progress of existing truth commissions and share experiences regarding best practices in terms of their establishment, their relation with other transitional justice initiatives, their functions and powers, their results, etc. A meeting of MTC members will be held in Jakarta, Indonesia, on February 21 to 24, in order to share with key Indonesian stakeholders the lessons learned in other countries and cooperate to identify the purported weaknesses of the existing project and help chart better alternatives. The meeting will facilitate closed-doors specialized discussion of the bill approved by the Indonesian parliament, as well as a public panel for journalists and the general public. Objectives 1.. To examine the bill proposing a Truth and Reconciliation Commission for Indonesia, as well as the proposal of a bilateral Indonesian and Timorese "Truth and Friendship Commission" identifying their weaknesses and arriving at recommendations to address the concerns of civil society. 2.. To share lessons learned around the world in fundamental aspects of the establishment of truth commissions, particularly regarding their functions, form of establishment, composition, powers and complementarity with criminal justice. 3.. To contribute to situate official truth-seeking in a comprehensive transitional justice strategy consistent with State duties, the rights of victims and the best practices identified in other experiences.
