Final Department of Labor Overtime Exemption Rule Issued - Employers Have Until
December 1 to Adjust Pay Practices to Comply With Sweeping Changes
This week, the U.S. Department of Labor issued its long-awaited final rule on
the minimum salary level required for exempt status under the Fair Labor
Standards Act (FLSA). The rule is complicated (over 500 pages, including the
DOL commentary) and contains many nuances employers must learn and plan for in
a relatively short period of time. The most basic element of the new final
rule, besides meeting the duties test for one of the so-called "white collar
exemptions", is that in order to be exempt from overtime pay an employee's
salary must be at least $913 per week, or $47,476 annualized. Although slightly
lower than estimates based on the proposed rule issued last year, this still
more than doubles the current minimum annualized salary of $23,660.
The huge changes imposed by this new rule are now final! There is no more
waiting, hoping for less impactful government regulation, or time to prepare.
The rule takes effect December 1st of this year. There is no exemption for
