All,
Hearings are always based on a single event or a group of events—with
specific dates. As a point of clarification, Malecon has a current
Entertainment License. As you may recall, after it was voted on by the
Commission to revoke their liquor license, the ABCC reversed the Commission’s
decision and we were directed to reinstate the license. The date of that
event was on or about December 25, 2020.
With that being said, we are proceeding on the violation of March 6, 2022
when a Springfield Police officer was present and provided a report to the
Licensing Department regarding alleged violations. That is the matter that
is scheduled for April 29, 2022.

Good evening Mayor and Deputy City Solicitor Days:
I am writing as a follow up to Ms. Matt's communication and to echo her
sentiments regarding the considerations for Malecon's entertainment license.
There needs to be a mutual respect between businesses and residents, and it
is disheartening to learn that the owners of Malecon have been disrespectful
and discourteous. This business has not yet undertaken to replace the
cracked window (photo below) caused by a prior disturbance. While the main
concern with entertainment is the level of noise and traffic, the lack of
attention to the window is perhaps exemplary of what has and may follow, with
more regular entertainment.
The residents of 26-32 Mattoon Street

have outside balconies and patios. The loud music and accompanying traffic
and associated sounds, make it impossible to sit outside to have a
conversation and enjoy a warm evening. The volume and sound waves sometimes
cause vibration of dishes and windows. At times, the music is loud enough
that it impacts being inside as well---as it can be heard within the units,
causing residents to turn up their TVs which in turn, perpetuates a problem
for other unit owners. It also makes it difficult to fall asleep in one's
own home, as Ms. Matt mentioned---even with windows closed.
As city dwellers being so close to downtown, some amount of noise is
naturally expected; however, consistent, excessive, loud noise that goes late
into the night that will interrupt a homeowner's peaceful enjoyment, is
unacceptable and will ultimately drive away current and prospective residents
of this historic street.
I am hopeful that all of the residents' concerns are heard and factored into
the decision. Further, while I have not seen whether Malecon has offered or
proposed any soundproofing or other measures, I would hope that these options
could also be explored and tested in earnest, and/or that other potential
limitations be considered, in an effort to compromise the legitimate concerns
of the residents should the city decide to grant the license.

Dear Mayor Sarno and Director Days:
When you consider the entertainment license for Malecon please bear in mind
those of us within the neighborhood who have been exposed to their excessive
sound and disturbance for some time.
You may know I have lived on Mattoon Street for many years. It once had
great promise and now we have a very uncertain future.
As in many of Springfield’s neighborhood’s we try to maintain our homes
because we love living here and take pride in being Springfield residents.
My house backs up to the Springfield Parking Authority lot on Pearl Street.
The distress we have encountered from the Malecon sound has become
overwhelming. Neighbors have approached the management with little or no
response and certainly with no respect. We are told to call the police and
we all do. It somewhat embarrasses me to call them with a noise complaint
with all they have on their plate.
As you both know, at the end of a stressful day all you want is peace and
quiet in your home. We haven’t had that. Some days it feels like their
entertainment is in my kitchen.
When I go upstairs to my bedroom, with windows closed, I often put a pillow
over my ears to drown out the music. I know I will have to graduate to a
head set if this passes.
It may sound a bit dramatic but it is the truth. I can deal with the
vagrants, the incessant litter, the drug dealers, and pan handlers that have
all but taken over our area but the very loud music can’t be tolerated.
