La cosa particolarmente interessante è che questa pratica è stata già
deprecata dalCongresso USA, che però ha lasciato tempo ad NSA di
proseguire in tale pratica fino al 29 Novembre.
Il commento del giudice, che ha al contrario deciso la cessazione
immediata dell'intercettazione ingiustificata nei confronti dei
cittadini ricorrenti, è stata:
“I did so with the optimistic hope that the appeals process would move
expeditiously,” he wrote. “However, because it has been almost two years
since I first found that the NSA’s Bulk Telephony Metadata Program
likely violates the Constitution and because the loss of constitutional
freedoms for even one day is significant harm … I will not do so today.”
Leon noted the government’s position: that “the immediate cessation of
collection of or analytic access to metadata associated with plaintiffs’
telephone numbers … would require the NSA to terminate the program
altogether.” But he indicated that was not his problem. “Unfortunately
for the government the court does not have much sympathy for these
last-minute arguments,” he wrote.

Il giudice Leon nota la posizione del governo:"L'immediata cessazione
della raccolta o dell'accesso analitico ai metadati associati ai numeri
telefonici dei ricorrenti ... richiederebbe che NSA termini tutto il
programma nel suo complesso". Ma indica che questo non è un suo
problema. "Sfortunatamente per il governo, la corte non ha molta
simpatia per questi argomenti dell'ultimo minuto."
