Hi Rich,
In general, up to 26 units can be leased at a time by applying for open
leasing status.  If we are at or below leased 26 units, then it's
relatively easy to apply for open leasing status and subsequently lease
your unit.  I'm not sure where we currently are, but we have around 26
units in open leasing status.  The 26 units are either already leased or
are looking for a tenant.  Generally unleased units in open leasing
status have 90 days to find a tenant.  The 90 day period only becomes a
concern when there is a waiting list.  This means that once you rent out
your unit, you can have your unit leased for many years, as long as you
don't go over 90 days without a tenant.
Whenever a leased unit changes ownership, the open leasing status
terminates.  However, if we are currently at or below 26 leased units
with no waiting list, then you and the prospective owner should contact
CMA prior to closing to make sure that it can still be leased after the
sale.
Once 26 units are leased and a 27th owner wants to lease their unit,
then a waiting list forms.  When a leased unit is sold, it falls off of
the open leasing list, and the first person on the waiting list becomes
eligible to lease their unit.  If one of the 26 units is unleased for 90
days or longer, it too falls off of the open leasing list if there is a
waiting list.
Another possibility is that 26 units are leased through the normal open
leasing process, there is a waiting list, and one or more additional
units have an "undue hardship" lease.  If there is a waiting list plus
one or more undue hardship leases, then the people on the waiting list
will need to continue to wait until less than 25% of the units in the
complex are leased.
To lease your unit, the first step is to reach out to Clara Sorrells. If there is a waiting list, then you'll be placed on the waiting list. If there is no waiting list, then you'll be eligible for open leasing
right away and can begin searching for a tenant.  Once you find a
tenant, CMA will need to review your lease, or they can probably provide
you with a standard lease with language that has already been vetted. There is a yearly $150 lease administration fee for vetting leases and
managing the leasing process described above.
