I just got it, too.  I had heard something about it from our Probate Court
judge who was highly upset. She felt like it basically bypasses all legal
requirements of adoption and puts what were clearly superior court issues
into the probate court domain.   It doesn't look like there is any action
for us to take yet on our local policies.  The governor could still veto.
I'm thinking of registering for the June 7th policy workshop in Savannah to
hear about this one and any others we may need to address.  Is anyone else
going?

Dear GSBA Policy Update Subscriber:



The Policy Alert for action taken during the month of *March 2018 *is as
follows:



*Litigation: *No policy implications



*Legislation:* The 2018 session of the Georgia General Assembly has
ended. As of this writing, one new piece of legislation with potential
policy implications has become law.



The Governor has signed *HB 159*, otherwise known as the adoption bill.
The bill becomes effective September 1, 2018, and will likely have policy
implications for student enrollment and employee leave policies.



*Policy code impacted*: JBC-School Admissions or other student enrollment
policy



*Issue*: Part II of the bill repeals the article relating to the power of
attorney for the care of a minor child (grandparent POA) passed in 2008 and
replaces it with a new article entitled the “Supporting and Strengthening
Families Act.” [HB 159 should not be confused with the Kinship Caregiver
Act passed in 2017, pertaining to affidavits executed by parents of
children not in DFCS custody.] The new article not only broadens beyond
grandparents the list of relatives to whom parents can delegate caregiving
authority, but also allows parents to give such authority to a “nonrelative
who is approved as an agent by a child-placing agency or a nonprofit entity
or faith-based organization for a period not to exceed one year,” with
certain exceptions. POAs granted to grandparents “may have unlimited
duration” and POAs granted by military parents “shall not exceed the term
of deployment plus 30 days.”  Further, the new code sections do not apply
to POAs given to grandparents “prior to September 1, 2018.”  A new POA form
is included in the Act for use after September 1, 2018.



*Policy code impacted*: GARH-Employee Leaves and Absences or other
employee leaves policy



*Issue*: Part III of the adoption bill adds a new code section 20-2-851.2
relating to sick, personal, and maternity leave for school employees. The
new code section provides that a local board “that permits paternity or
maternity time off for biological parents following the birth of a child
shall, upon request, make such time off available for individuals adopting
a child in the same manner and utilizing the same type of leave.”



*Action to be taken*:



GSBA is analyzing the adoption bill and the final version of others that
passed the House and Senate and is monitoring whether the Governor signs,
vetoes, or allows them to become law without his signature once the 40-day
deadline has passed. Information will be provided in future Policy Alerts
and Updates.



A thorough review will be provided at the GSBA Policy Workshop in Savannah
on June 7th.
