During the morning session, all but one speaker was against the bill. Among the early speakers was Professor Serge Martinez of Hofstra Law School who told the legislators that statements made by supporters of the bill concerning its constitutionality were suspect. The bills few supporters claim that such legislation is clearly constitutional. Prof. Martinez said that at least one court had found a similar law unconstitutional and that while two other courts had found similar laws constitutional, their decisions did not apply in New York. The upshot being that the county was buying itself a lawsuit if the bill passed. The afternoon hearing, with more than 30 people testifying, was more evenly divided between speakers in favor of the bill and those opposed. An all White group which described itself as border patriots made up the biggest contingent of supporters of the measure. They were joined by a few construction trades unions. Folks seeking sensible solutions were there in good numbers, but there is a fear that our work is being undermined by backdoor dealings.
