Good evening everyone,
Community Councils in Scotland are indeed 'statutory consultees' on all
planning applications within their area, as detailed in the Local Government
(Scotland) Act 1994 and further described in Planning Advice Note 47.
This means they have the right to be notified and consulted on planning
applications, and for the response made on behalf of their community to be
considered by Officers and Elected Members when making decisions on the
applications in their area.
If our Community Council has not been notified of this planning applications,
it should be possible to request that the 'consultation period' for the
planning application begins again from the date that the planning application
is notified to and shared with the Community Council from the City Council's
Planning Department.
In addition, it is also possible for the Community Council to request an
additional 15 days of time to respond to the application as agreed between the
Community Council Forum and City Council officials in the 'Planning Process
Agreement' taken forward by myself and other representatives in 2015.
Also, do we know if there is currently an Application Reference Number on the
sign, that could be searched on the online document archive?
As Chairperson of Castlehill and Pittodrie Community Council, I would recommend
and fully support our:
- Requesting to Planning Department that the 'public consultation' time begins
again, as and when we and residents are notified of the application in the
correct procedure.
- Requesting to Planning Department that we receive an additional 15 days (as
described in the Planning Process Agreement) to consult with our community, and
gather views to present in response to the application.
- Holding a village meeting in the Fittie village if residents there would like
to have the chance to discuss the application and their views on its potential
benefits and detriments, as they reside closest to the site of the application
and may experience the most impact if it is granted.

Good afternoon, all,
A neighbour came to my house today to alert me to the fact that a planning
application had been posted on a drainpipe attached to the Silver Darling
restaurant. This is not visible to the houses that line the street overlooking
the restaurant.
My neighbour was concerned as her house backs on to the restaurant and she- nor
any other resident of Fittie, adjacent to restaurant or not- has not been
notified.
Neither has Castlehill and Pittidrie Community Council.
As this hard-to- find sheet of A4 reminds interested parties where plans can
be seen and the time frame for objections/ expression of concern
(Already a week gone from the date written), residents who wish to exercise
their rights are already backfooted.
As this planning application represents changes which will be detrimental to
the village of Fittie. Namely, nowhere for restaurant users to park, increased
footfall through village which is already at breaking point with volume of
tourists,no respite from 7 days a week, 9am to 9pm, increased traffic squeezing
down our 'access only" 20 mile an hour road and seating for 40 plonked down in
our Harbour front- changing the entire nature of our environment, we appeal to
our councillors for help here.
It may be necessary for a village meeting to held in time for response to
planning to be submitted?. What is the opinion of the CC and Councillors?
