Hello Civil and regular collab law listserv mates:
I am writing an article about efforts to expand collaborative practice beyond
family law and am trying to locate any additional "full Collaborative" cases
(meaning signed agreement with dual disqualification). David Hoffman did an
initial survey in September 2006. I am interested in cases that have happened
since then, and already know of the following:
- Cases mentioned at the Toronto IACP forum, including the Boston area business
case handled by Michael Zeytoonian and Paul Faxon, probate cases handled by
Bill Andrews, and the case handled by Sherrie Abney and Larry Maxwell.
- The Australian business case discussed in Robert Lopich's article in
February's ABA Just Resolutions newsletter.
I'm interested in any leads you have on these cases. I'm interested in the
number as well as more details about them and attorneys who handled them. I'm
also interested in, "How did you get both attorneys to agree to sign onto the
participation agreement" (with disqualification. As those of you who've
followed civil efforts know, we've gotten a slow start on this, partly because
the attorney marketplace in some of these practice areas is so different than
that of family law.
I am stubborn though, and not letting go of the idea that some day, CL/CP will
be viable in a number of practice areas.
I'm also interested in hearing from anyone who has used collaborative tools to
resolve civil cases that didn't meet the definition of CL/CP (because neither
or both attorneys would sign the agreement, including disqualification.)
I'm interested in learning more about what works and what didn't in these other
types of cases.
