This sounds like getting married but reserving the right to divorce if the 
marriage is not successful. First of all, the level of commitment seems low. 
and 
second, without knowing what case law may be on "condonation"-- ALL 
settlement talks have ALWAYS been inadmissible. So how could anything that was 
part of 
a mediation OR a collaboration (or litigated settlement negotiations) 
"condone" anything?
