The bill started out as part of our Civil Practice and Remedies Code, but the
PI lawyers opposed it for obvious reasons, as did factions of the ADR section
of the bar for not so obvious reasons. Once we agreed to move it to the Family
Code where it would do no violence to the contingent fee tradition of trial
lawyers or threaten competition to the civil mediators it was reasonably smooth
sailing. Primary concern came from the judiciary, who were understandably
concerned about having a docket full of cases they had responsibility for but
no control over. Hence the "2 year compromise", which certainly seems
reasonable to me. The lion's share of the credit for passage goes to Harry
Tindall, one of our very best family lawyers, who has tremendous credibility in
with the legislature, boundless energy, and who has become a committed convert
to the cause. Norma and I claim credit for that evangelistic effort. The
future looks very interesting. Glad I have stayed around to see it.
