1. Parties have used arbitration in a couple of cases of impasse, but we do
not provide for this is the agreements--it's a brainstorming decision at
impasse. The role of the collaborative attorney needs to be carefully limited
to
recitation of facts without adversarial presentation --or trial lawyers
retained for the process.
