Now that I'm back from my 'happy happy', I want to remember how truly 
scared and sad many of our clients are. Often their 'annoying' factor is 
related to deep feelings of abandonment and complicated loss. 

But now I want to wish you all a 'happy happy' for 2011 and beyond,

I actually think that the steps, protocols or choreography, help keep us 
focused and give us a firmer foundation to refer back to when things get 
dicey, whether with the clients or between Team members. If we are going to 
change the dance steps then it is in response to the needs of the clients, or 
the team but it is done mindfully and with care. best to all our 
colleagues in the new year.

My lessons are continuing ones: I need to practice skillfully, which
includes following the protocols-those of the MA Collaborative Law Council
were carefully drawn up by seasoned and dedicated practitioners-and
deviating from them only when truly appropriate to a situation, which the
team has fully vetted together. The other part of my continuing lesson is
that I must practice with compassion and sensitivity, and be open to being
held accountable, by either party or any team member, when I make missteps.

The most important thing I have learned in the past five years as a
collaborative coach is that the clients own the outcome but the team owns
the process.
Some wise collab professional said "When you get on the plane headed for
California, they don't let any of the pasengers decide they want the plane
to fly to Utah."
Successful cases require that the team stay on course despite how difficult
it becomes.

Here is a lesson I hope I have learned -- I realized too late in a 
collaborative case this year that my client needed a coach. I missed the signs 
during the week or two time slot during which the symptoms were evident and the 
case blew up.

I had made the wrong assumptioms about which spouse would be hardest to work 
with in the collaborative context---i.e. which spouse would need non-lawyer 
coaching support. (In our group the fully staffed case is still not the norm.)

Having stubbed my toe twice in this regard during the first decade of the 
century, I hope I have learned my lesson.

On the bright side, I have gone another collaborative year in which each and 
every collaborative case client has paid my fees in full, including the lady I 
failed to get coached in time.
