On June 3, 2017, NSA contractor Reality Leigh Winner was arrested and charged
under the Espionage Act for allegedly providing a media organization with a
top-secret document that analyzed information about alleged Russian online
intrusions into a U.S. election.
Winner has now been sentenced to five years in prison, the longest sentence
ever given in federal court for leaking information to the media.
Several months before Winner's arrest, the FBI’s then-Director James Comey told
President Trump that he was (in the words of a subsequent Comey memo) “eager to
find leakers and would like to nail one to the door as a message.” Meanwhile,
politically connected and high-level government officials continue to leak
without consequence, or selectively declassify material to advance their own
interests.

Reality Winner was concerned with the integrity of U.S. elections. In order to
alert the public to what she believed was a critical threat to U.S. elections,
she gave classified information to The Intercept. The information she leaked
harmed no one.
The Intercept, at the request of the National Security Agency, redacted the
name of a Russian intelligence unit in the documents obtained from Winner. It
was Special Counsel Robert Mueller who made that name public in an indictment
containing similar information to that leaked by Winner. How such information
could harm "national security" at all, much less do so in Winner's case but not
in Mueller's, is unclear.
Winner was not given a fair trial. The Espionage Act allows for no public
interest defense, and rulings by the judge in the case severely curtailed
Winner’s ability to defend herself.
President Obama normalized the practice of charging whistleblowers under the
Espionage Act, a statute intended for spies. We must not allow this practice to
continue.
