If you live in Shelby County, it would be very helpful to contact your
country commissioner to get a little more background information on how and why
these rules/definitions are being considered at this point in time. Has
something happened specifically to drive this?
The ACC is seeing an increase in local governments considering more animal
ordinances, some of them more restrictive, but all of them with vague
wording such as these definitions. Shelby County residents must be the ones
to get information and make contact with your commissioners since you live
there and you VOTE there. We'll be glad to help you as we are currently with
residents in both Montgomery and Lincoln about animal issues in both
places. When you can give us more information about what's going on, we'll
know better what questions to ask and how to help you.

The Shelby County Department of Develop­ment Services is asking the
county's planning commis­sion to adopt definitions it hopes will help in
addres­sing complaints about dogs.
Development services has proposed adding to the county's zoning laws the
definition of a kennel, which is currently not specified. The county zoning
law specifies where kennels can be, which includes in agri­cultural
districts and areas zoned for animal hospitals and clinics, but it does not
define what a kennel is.

"The issue of 'kennels' and the keeping of dogs is a topic that arises
from time to time as the subject of citi­zen complaints," Develop­ment
Services' staffers wrote in a report to the Planning Commission. "When
these complaints are received, Development Services mo­bilizes the
enforcement staff to review the situation on site. Typically, however, the
issue
is not resolved be­cause of the inability of staff to identify a
violation of the Zoning Regulations."
The staff has recom­mending the following defi­nitions:
> Kennel (commercial):
For the purpose of this Ordi­nance, a Kennel (commer­cial) will be
considered as any combination of struc­tures, pens, areas or
enclo­sures, covered or uncov­ered, where five or more dogs, cats or
other
domestic animals are kept for the pur­pose of boarding, breeding,
raising, grooming or train­ing for sale, compensation or any other
commercial purpose. A Kennel (com­mercial) may be located in a rear yard
and
shall be lo­cated no less than 75 feet from any side or rear prop­erty
line.
> Kennel (non-commer­cial):
For the purpose of this Ordinance, a Kennel (non­commercial) will be
consid­ered as any combination of structures, pens, areas or enclosures,
covered or un­covered, where four or more dogs, cats or other domestic
animals over six months of age are kept for the purpose of boarding,
breeding, rais­ing, grooming or training for personal/non-commercial
enjoyment. A Kennel (non­commercial) may be located in a rear yard but
must
meet the zoning setback require­ments for the applicable zone district.
At its last meeting, the planning commission voted to allow the staff to
advertise the proposed definitions.
Senior County Planner Tom Wilkins said the pro­posals will go before
the planning commission dur­ing a public hearing at its Sept. 20 meeting.
The commission may vote to recommend the pro­posed definitions to the
Shelby County Commission, vote against recommending them or delay taking a
vote, Wilkins said.
Some planning commis­sioners said they thought the definition needed
go fur­ther in ways such as includ­ing what type structures would be
allowed in a ken­nel. However, they voted unanimously to let the
pro­posal go forward, saying they thought it was at least a "start."
County planner Sharman Brooks said the staff needs the definitions to
address the issue of kennels.
"We're not trying to pe­nalize people who have dogs," Brooks said.
"That's not what we're trying to do." Anything adopted by the county would
only apply to areas of the county that are covered by zoning. It would not
apply to unincorporated areas without zoning regula­tions.
