Shelby  County Planning Commission to consider  vague definition of “kennel”
on Monday, September  20 

The Shelby County Planning Commission will  consider adding a “kennel” 
definition to their zoning code on Monday,  September 20 at 7:00 p.m.  
Concerned dog owners are encouraged to attend  and participate in this 
important 
discussion.
 
The American Kennel Club’s staff is concerned  that the proposed definition 
is vague and subject to broad interpretation by  current and future codes 
inspectors. The proposed definition is as  follows:
 
Kennel  (commercial) 
For the purposes of this Ordinance, a  Kennel (commercial) will be 
considered as any combination of structures, pens,  areas or enclosures, 
covered or 
uncovered, where dogs, cats or other domestic  animals are kept for the 
purpose of boarding, breeding, raising, grooming or  training for sale, 
compensation or any other commercial purpose.
 
It is unclear how this kennel definition  would impact hobby breeders who 
occasionally offer puppies or dogs for  sale. It is also unclear if kennels 
(commercial) would be allowed on  residential properties. “Commercial” is 
not defined within the current  zoning regulations.
 
Further, it is inappropriate to regulate duly  incorporated businesses such 
as boarding kennels, grooming parlors and  training facilities in the same 
manner as small breeders.  
 
If approved by the planning commission, the  amendment will advance to the 
Shelby County Commission.  The definition  and corresponding restrictions 
would apply only to those areas of  unincorporated Shelby County that have 
zoning. 
 
Current zoning regulations indicate that a  “kennel” is a permitted use in:
 
·         A-1 Agricultural Districts – allows kennels provided that open  
pens or runs are located not less than 75 feet from any lot line.
 
·         B-2 General Business Districts – allows hospitals or clinics for  
animals, but not including open kennels. 
 
·         M-1 Light Industrial Districts – allows animal hospitals or  
clinics including open kennels.
 
·         Kennels are not mentioned in residential context in the Zoning  
Regulations.
 
The Shelby County Planning Services  Department also recommends that “the 
Planning Commission request that the  Shelby County Commission consider the 
preparation of comprehensive Animal  Control Regulations applicable to 
unincorporated Shelby County.” 
 
The American Kennel Club strongly endorses  the right to own, keep and 
breed dogs in a responsible and humane manner. We  believe that responsible dog 
ownership is compatible with most living  arrangements.
