Pardon this comment from a beginning birder.

It seems to me, from reading the posts, that there is no dispute that
playing tapes of bird calls is illegal in publicly owned parks and forests;
the original question was on the "birder's ethics" of doing so even in
places where it would not be specifically prohibited.

This seemed also to be what the poster before Mr. Kane's long post, ecj100,
was saying:

parks,

particularly those with some devotion to conservation, use of tapes (or

CDs,

etc.) is forbidden.

I've found this discussion very interesting and useful.  As a new birder of
this year, I've been on many guided bird walks where a bit of pishing was
done.  Pete Dunne's book (Pete Dunne on Bird Watching) has five pages on
pishing and how to do it.  I read about bird tapes being used in Ken Kaufman
s excellent Kingbird Highway,  I am very interested to know that both of
these practices are controversial in the birding community.

Yes, and with all due respect,your extreme rendition of a crime in progress
grew real tiresome before I was able to wade through it.  Perhaps the
Federal regulation you cited is in need of an exemption or two.

I'm retired from the U.S. Fish and Wildlife Service and for 12 years of my
career I was a National Wildlife Refuge Manager.  Let me assure you that I
had much more important things to do than to bust some birder for playing a
bird call tape.  I also had more discretion and good sense than to bother a
U.S. Attorney with such a trivial and reletively harmless activity.
