All,
Yesterday, I spoke with a Wild Life Biologist from the US Fish and
Wildlife Service, two Federal natural resources law enforcement officers, an
Acting Chief of Police from a National Park Service Venue, and a Public
Affairs
representative of the United States Department of the Interior.
Everyone I spoke with agreed 36. 2.2 (a) (2) is in fact the controlling
statute. Is the statute in need of an exception or two, personally I think
not. But, the statute is what is. And, we really should not have another
debate
regarding what the meaning of the word is, is.
And, of course, our Law Enforcement officials are much to busy to be
policing birders with tape recorders, continuos loop tapes, I Pods, external
speakers, and the like. This is one of the reasons the statute ought to be
respected. Where the is a legitimate need for certain research to be done, we
have
plenty of qualified researchers to perform this function.
Regardless, Mr. Kline, I sincerely appreciate your response to my post.
