Ladies and Gents The Friday Conundrum! A number of us are involved in the authorisation of temporary traffic signals a colleague of mine in Streetcare (our Highway Maintenance and NRSWA co-ordination section) has highlighted what at first site would appear to be an anomaly between TSRGD and the new Ch 8 As I (and from previous correspondence most of the rest of us!) read it Traffic Signs Regulations and General Directions 2002 (the TSRGD) Part II Direction 53 provides the requirement that permission is required from a traffic authority for the placement of portable light signals on the highway. Obviously an authority may consider applications to operate a system of general prior approval for 'exceptional' circumstances (Direction 53(2). In such 'exceptional' circumstances the placement of portable light signals for Categories of Work of Emergency, Urgent, Special Cases of Urgent and Remedial Dangerous should still require Formal Authorisation (although most of us will allow works to start with written authorisation following.) The new Chapter 8 would appear to be contrary to this stating "D5.10.3 Normally the approval of the traffic authority will be required before portable traffic signals are placed on the highway (see direction 53). Where undertakers under powers place portable traffic signals on the highway in the New Roads and Street Works Act 1991 then prior approval is not required. However, the undertaker must give advance notice of the use of portable traffic signals (NRSWA 1991 sections 54 and 55). The traffic authority may give directions as to the use of portable traffic signals.
