The Health Insurance Portability and Accountability Act, better known as
HIPAA, goes into effect Monday, April 14, 2003. The HIPAA establishes
federal laws to govern the handling of medical information over the
patchwork of state laws currently in existence. The act includes
prohibitions against such practices as hanging charts on a room door,
putting names on the first page of a chart, and leaving medical records on
a doctor's desk where others may get at them. John Lawson, president of the
Medical Society of the District of Columbia, believes such policies burden
physicians and staff with duplicative paperwork for both government and
insurance, and that the required information practices are standard without
federal regulation. Some consumer advocates, such as Charles Inlander,
director of the People's Medical Society, disagree. Inlander recalls
overhearing casual conversations detailing various patients' conditions
while visiting his father in the hospital. Intentional un!
authorized disclosures of information are punishable by $50,000 fine and a
year in prison; disclosure with intent to sell warrants a $250,000 fine and
10 years in prison.
