Personally, I'd lean pretty hard towards Broad-winged. The breast/upper belly spots are very distinct, rather than streaky. It does look big-headed and big-eyed like a Merlin, but it's also nearly a dead ringer for the immature Broad-winged on Cornell's "All About Birds", which is very similar in proportions. If it was in a wooded area, that would also favor Broad-winged.
