Yet nothing has been done, despite the passage of the Endangered Species Act, the Migratory Bird Treaty Act, rules protecting of wetlands and numerous state and local laws aimed at safeguarding wild birds. That may be about to change. On Nov. 3, in an action that received little news coverage, the Federal Communications Commission, after years of inaction, announced it would propose rules to deter bird collisions with towers. It also wants to find out if it has the legal authority to address the problem. The move came in part as a response to a lawsuit filed in 2002 by the American Bird Conservancy, Friends of the Earth and the Forest Conservation Council. The suit charged that the FCC should have ordered measures to reduce bird collisions.
