I'm surely no expert, but this is my take on the above.

Merles were an early part of the GSD breed, as were
brindles. However, IMO, the M gene was bred out a long
time ago. Merle (M) is an incompletely dominant trait. As
such, it would not tend to be "carried" along, silently
and unseen, throughout the many, many years and
generations only to pop up unexpectedly as the "panda"
color trait apparently did. And while "cryptic" (phantom)
merles do appear in the breeds where the M gene is common,
one would expect that, if such animals existed in any
significant number within the GSD gene pool at large, that
at least one of them would produced a Merle GSD puppy at
some point in time, and probably a lot sooner than was
seen with the pandas.  <shrugs>

At any rate, the color was studied and you'd think that
they would have eliminated M as a possibility right away,
seeing as they DO have a genetic test for Merle now.
